A relaxed Former Spy Chief Isaac Kgosi today appeared before the Broadhurst Magistrates court arguing that a warrant of arrest issued against him be set aside because he could not attend court because he was hospitalized in Malaysia and could not travel back to Botswana.
These arguments were rejected by the court and Kgosi was ordered to submit himself for medical examination before a state doctor to determine if the condition was of a serious nature so judgement could be made on the matter at the same court at 4pm today.
Thabiso Tafila, of Thabiso Tafila Attorneys, said “Our client had to submit himself to medical treatment in Malaysia. He was not able to return in time to meet bail conditions.”
He said, “The warrant of arrest should be suspended becayse he was receiving medical treatment.
Kgosi is accused of exposing agents of the Directorate of Intelligence and Security (DIS) service to the public by releasing pictures of them knowing that is an offense to disclose their identities.
The particulars of the offence are that the accused person, Kgosi, between February 18 and 25, 2019 in Gaborone took photographs of officers as well as the identity cards of the officers engaged in a covert operation of DIS and is also being charged with obstructing officers and support staff.
Thato Dibeela, Chief Prosecutions Counsel at the Directorate of Public Prosecution (DPP), said “The accused should be examined by state doctor who should advise court on his medical condition. If doctor is unable to findings in writing he should be compelled to appear before court.”
